Delineate of the Purchase Contract:
This purchase contract is prepared generally into an preliminary section which consist of four major sections Section A , Section B , Section C and Section D. Section C is the major section and known as “meat ” of the contract form. Section C started from page two and continues till page twelve having seventy-nine paragraphs.
A brief Review of Four Majors Sections:
Section A: First section surrounds “Agency disclosure” which is required by Brokerage Firms to make parties if those Firms provide an agent or other representative in that transaction. Section B: This section serves buyer’s initial deposits that are approved by Buyer’s agents. This section also mentions the interest, which will be given to Buyer for deposits.
Section C: As already mentioned this is main part of purchase contract and this section includes the Offer’s terms and conditions to buy property, continue from C-1 to C-79. This section also contains list of supplementary document called Addendum (for one document) and Addenda (for more than one document). These documents may be attached for reference and may be part of purchase contract.
Section D: This section is based on Sellers acceptance that whether he is accepting the Buyer’s Offer and commission rated mentioned by Brokerage Firms. If Seller disagree with Buyer’s Offer seller will attach HAR’s standard form of “counter Offer” to show his rejection.
HAR standard form “Cooperation Brokerage Firm’s” is mostly attached with the purchase contract. This agreement is between two brokerage Firms one of Buyer and other of Seller side. Its purpose is to divide the commission listed for Brokerage Firms. Sometimes it splits equally and sometime compensation is given to Buyer’s Brokerage Firm.
